Read Better Be Better SMS Use Case Description

“Read Better Be Better, based in Phoenix Arizona, focuses on connecting young readers and youth leaders to inspire a love of literacy and leadership. Messages are sent to students, volunteers, and external partners to coordinate programs, send appointment reminders, coordinate student schedules, and provide satisfaction follow-ups for student volunteers. Message frequency may vary. Phone numbers are collected when individuals opt in to receive SMS messages from Read Better Be Better programming and volunteer efforts.”

Text Messaging Agreement

This Agreement sets forth the terms of use, for text messaging between Read Better Be Better (“RBBB” or “us”) and you. By opting in or using the Text Messaging Service (as defined below) you agree to the following terms and conditions.

  1. Opting In. “Opting In,” “Opt In,” and “Opt-In” refers to requesting, joining, agreeing to, enrolling in, signing up for, acknowledging, responding to, or otherwise consenting to receive one or more text messages from RBBB.
  2. Text Message Service includes Microsoft Teams text message service or any other arrangement, service or situation in which RBBB sends one or more messages addressed to your mobile phone number, including text messages (such as SMS, MMS or other or successor protocols or technologies.)
  3. Consenting to Text Messaging. By Opting In and agreeing to accept text messages for education, customer care and account notifications from RBBB, you agree to these Text Messaging Terms and conditions as well as our Privacy Policy, incorporated herein by reference.
  4. E-Signing. By agreeing to receive text messages, you also consent to the use of an electronic record to document your agreement. You may withdraw your consent to the use of the electronic record by replying STOP.
  5. RBBB Text Message Service Privacy Policy. We respect your privacy. We only use information you provide through this service to transmit your mobile messages and respond to you. This includes, but is not limited to, sharing information with platform providers, phone companies, and other vendors who assist us in the delivery of mobile messages. Mobile information will not be shared with third parties/affiliates for marketing/promotional purposes. All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties. Nonetheless, we reserve the right to disclose any information necessary to satisfy any law, regulation or governmental request, to avoid liability, or to protect our rights or property. This Text Message Service Privacy Policy applies to your use of the Text Message Service and is not intended to modify our general Privacy Policy, incorporated by reference herein, which may govern the relationship between you and us in other contexts.
  6. Costs of Text Messages. We do not charge you for the messages you send and receive via this Text Message Service but message and data rates may apply, so depending on your plan with your wireless or other applicable provider, you may be charged by your carrier or other applicable provider.
  7. Frequency of Text Messages. This Text Messaging Service is for conversational person-to-person communication between you and our employees. We may send you an initial message providing details about the service. After that, the number our text messages you will receive will vary depending on how you use our services and whether you take steps to generate more text messages from us (such as sending a Help request). Message frequency may vary.
  8. Opting Out of Text Messages. If you no longer want to receive text messages, you may reply to any text message with STOP. As a person-to-person communication service, opt-out requests are specific to each conversation between you and one of our employees and their associated phone number. After unsubscribing, we may send you confirmation of your opt-out via text message.

  10. Arizona Law. All terms and conditions of this Agreement and the effect thereof shall be interpreted under the laws of the State of Arizona.
  11. Severability. If any provision in this Agreement is held to be invalid, void or illegal by any court of competent jurisdiction, that provision shall be deemed severable from the rest of the Agreement and shall in no way affect, impair or invalidate any other provision.
  12. Entire Agreement. You and RBBB agree that this Agreement contains the entire agreement between the parties as to the subject matter of this Agreement and supersedes all other prior or contemporaneous representations, agreements and understandings, oral or otherwise, with respect to the matters herein.
  13. Waiver of Rights. You have been advised to seek the advice of an attorney before Opting In to this Agreement, you have had an opportunity to consult an attorney regarding this Agreement, and you have either done so or have waived your right to do so prior to Opting In to this Agreement.
  14. Dispute Resolution. If there is a dispute which refers, relates or arises out of this Agreement, the parties agree that they will resolve the dispute through the American Arbitration Association and pursuant to the Commercial Dispute Resolution Procedures. If there is a dispute, you also agree to waive the right to file or join a class action and instead agree to pursue any legal claims you may have against RBBB individually in arbitration.
